These Terms of Service (“Terms”) apply to your access to and use of Panda Cub Studios games (including Scrambled) and related services (the “Services”), and to our website https://pandacubstudios.com (the “Website”).

By downloading, installing, accessing, or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who we are and how to contact us

Panda Cub Studios (“we”, “us”, “our”) is an independent game studio based in the United Kingdom.

If you need to contact us by post for a formal request, email us and we will provide a correspondence address.


2) Privacy Policy

3) Eligibility / age

Our Services are intended for users aged 13 and over.

If you are under 13, you must not use the Services. If you are a parent/guardian and believe your child under 13 is using the Services, please contact us.

You must also be legally allowed to use the Services in your country. If applicable law requires parental/guardian consent for purchases or certain data processing, you must obtain that consent.


4) Your device, connectivity, and accounts (login is optional)

You are responsible for:

  • your device and its compatibility,
  • internet/mobile data charges, and
  • keeping your device secure.

Login is optional. You can play our Games without logging in. However, some features may require sign-in, such as linking/syncing progress across devices or accessing certain social features.

If you choose to sign in (Google, Apple, or email), you are responsible for keeping access to your account secure. If you believe your account has been compromised, contact us.


5) License to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial entertainment purposes, as long as you follow these Terms.

We (and our licensors) own all rights in the Services, including software, artwork, audio, logos, trademarks, and other content, except where stated otherwise.


6) Rules and acceptable use

You agree not to:

  • cheat, exploit, or use bots/macros/automation,
  • reverse engineer, decompile, disassemble, or attempt to derive source code (except where the law allows this),
  • bypass or interfere with security or access controls,
  • use the Services to harass, threaten, or harm others,
  • upload or transmit malicious code,
  • use the Services for commercial purposes without our written permission.

If a game includes leaderboards/high scores or other social features, you agree to play fairly and follow any in-game rules we publish.

We may remove content (such as offensive usernames) and restrict access to protect players and the Services.


7) Ads

Our Games may include advertising (including via third-party partners such as Google AdMob and Unity Ads).

Ad behaviour (personalised vs non-personalised) may depend on:

  • your device settings,
  • your region, and
  • choices/consent you provide in-game.

We are not responsible for third-party ad content, offers, or websites linked from ads.


8) In-app purchases (IAP), subscriptions, and virtual items

Our Games may offer in-app purchases such as consumables, non-consumables, and/or subscriptions (“Virtual Items”).

Purchases are processed by Apple or Google (or the platform you used). We do not receive your full payment card details.

  • Prices and availability can change at any time.
  • Virtual Items have no real-world monetary value and cannot be exchanged for cash.
  • Virtual Items are generally non-transferable.

Refunds

Refunds are handled according to the policies of the store/platform where you made the purchase (for example, Apple App Store or Google Play). If you have purchase issues, contact us and we’ll try to help, but we cannot guarantee refunds because the store controls payments.

Nothing in these Terms affects your statutory rights as a consumer under applicable law (including UK consumer laws).


9) Updates, changes, and availability

We may update, patch, modify, or remove features of the Services to:

  • improve performance, gameplay, and stability,
  • fix bugs,
  • maintain security,
  • comply with law, or
  • reflect technical changes.

We do not guarantee the Services will always be available or error-free. Sometimes downtime may occur for maintenance or reasons outside our control.

If we ever discontinue a game or an online feature, we will try to provide reasonable notice where practical.


10) User-generated content

Some Services may allow you to provide content such as usernames or other text (“User Content”). You must ensure your User Content:

  • is not illegal, hateful, abusive, sexually explicit, or harassing,
  • does not infringe someone else’s rights, and
  • does not include personal data you shouldn’t share.

We may remove User Content and/or restrict access if it violates these Terms.


11) Termination and enforcement

We may suspend or terminate access to the Services if you:

  • violate these Terms,
  • engage in cheating or fraud,
  • attempt to harm the Services or other users, or
  • create legal or security risk.

If your access is terminated, you may lose access to Virtual Items or progress (especially if not synced). We are not required to provide compensation where permitted by law.


12) Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”.

We do not guarantee that the Services will meet your requirements, be uninterrupted, or be error-free.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so (for example, liability for death or personal injury caused by negligence, fraud, or other non-excludable liability).


13) Limitation of liability (UK-friendly)

To the fullest extent permitted by law, Panda Cub Studios will not be liable for:

  • indirect or consequential losses,
  • loss of profits, business, or goodwill,
  • loss of data (unless caused by our failure to use reasonable care and skill where required),
  • issues caused by your device, your internet connection, or third-party services/platforms.

Where we are liable to you, our liability is limited to the amount you paid to us (if any) for the relevant Services in the 12 months before the issue arose, unless applicable law requires otherwise.

Nothing in these Terms affects your statutory rights as a consumer.


14) Third-party services and platforms

The Services may integrate with third-party services (such as Apple, Google, Firebase, AdMob, Unity Ads). Your use of those services may be governed by their own terms and policies.

We are not responsible for third-party services that we do not control.

17) Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from mandatory consumer protections in your country of residence where applicable. Disputes may be brought in the courts of England and Wales, unless consumer law in your country gives you the right to bring claims elsewhere.
